Terms of Service

These Terms of Service ("Terms") govern your access to and use of PostaiLit ("Service", "we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

1. Definitions

• Account — the user profile created when you register at postailit.com.
• Brand — your business identity, including logos, colours, and brand assets submitted to the Service.
• Content — social media posts, images, captions, and other materials generated through the Service.
• Service — the PostaiLit AI-powered social media automation platform accessible at postailit.com and business.postailit.com.
• Subscription — your agreement to pay recurring fees for ongoing access to the Service.
• You / Client — the individual or business accessing the Service.

2. Access and Use

2.1 Grant of Rights

We grant you a limited, non-exclusive, non-transferable, and revocable right to access and use the Service during your active Subscription, solely for your internal business purposes and in accordance with these Terms.

2.2 Restrictions

You shall not, and shall not permit any third party to:

• Copy, reproduce, modify, or reverse engineer the Service or any part of it
• Use the Service for any illegal, fraudulent, or unauthorised purpose
• Generate or distribute content that violates any applicable law or third-party rights
• Generate sexually explicit, pornographic, or harmful content
• Attempt to gain unauthorised access to the Service or related systems
• Resell, sublicense, or make the Service available to third parties without our written consent

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Notify us immediately if you suspect any unauthorised access.

2.4 Enforcement

We reserve the right to suspend or permanently terminate any account at any time, without prior notice, if we determine that usage violates these Terms, applicable laws, or our content policies. Such actions may be taken immediately and without liability to you.

3. Services

3.1 Service Delivery

The Service is delivered upon providing you with account access. PostaiLit uses automated systems to generate social media content, images, and captions based on your brand information. All generated content is presented for your review and approval before publishing.

3.2 AI-Generated Content

Due to the nature of AI-generated content, results may not be unique and similar content may be produced for other users. You are responsible for reviewing all content before approving it for publication.

3.3 Social Media Publishing

By connecting your Facebook and Instagram accounts, you authorise PostaiLit to publish approved content on your behalf. You remain responsible for ensuring your use of those platforms complies with their respective terms of service.

3.4 Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party API changes (including Meta), or unforeseen technical issues may temporarily affect the Service.

4. Payment and Billing

4.1 Fees

Current pricing is displayed at postailit.com/pricing. All fees are in USD unless otherwise stated. We may modify pricing with 30 days notice.

4.2 Billing Cycles

• Monthly plans are billed monthly in advance
• Annual plans are billed annually in advance
• Subscriptions renew automatically unless cancelled before the renewal date

4.3 Cancellation

• You may cancel at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• You retain access until the end of your paid period

4.4 Refund Policy

All payments are final and non-refundable. PostaiLit does not offer refunds, credits, or pro-rated amounts for partial subscription periods, unused features, or early cancellation. By subscribing, you acknowledge and agree to this no-refund policy.

If you believe you have been charged in error, contact us at support@postailit.com within 7 days of the charge and we will investigate.

4.5 Failed Payments

If a payment fails, we will attempt to retry the charge. If payment remains unsuccessful, your account may be suspended until the outstanding balance is resolved.

4.6 Taxes

You are responsible for any applicable taxes, duties, or government fees in your jurisdiction. Prices displayed do not include taxes unless stated.

5. Intellectual Property

5.1 Our Property

All elements of the Service — including software, algorithms, platform design, and infrastructure — remain the exclusive property of PostaiLit. Nothing in these Terms transfers ownership of the Service to you.

5.2 Your Brand and Inputs

You retain all rights to your brand assets, uploaded photos, and input materials. You grant us a limited licence to use them solely to provide the Service to you.

5.3 Generated Content

You own the content generated for your account, subject to the non-exclusivity provisions in section 3.2. You are responsible for ensuring generated content does not infringe third-party rights before publishing.

6. Disclaimers and Liability

6.1 As-Is Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and uninterrupted operation.

6.2 No Guarantee of Results

We do not guarantee specific results, engagement levels, follower growth, or business outcomes from use of the Service. Social media performance depends on many factors outside our control.

6.3 Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to the Service shall not exceed the total fees paid by you in the six months immediately preceding the event giving rise to the claim.

6.4 Service Modifications

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time. Continued use after changes constitutes acceptance of the updated Service.

7. Privacy and Data

We process your data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

8. Termination

8.1 By You

You may cancel your account at any time from your account settings, subject to the terms in section 4.3.

8.2 By Us

We may suspend or terminate your access immediately and without notice for: breach of these Terms, non-payment, illegal or harmful use, or violation of third-party rights. Termination does not entitle you to a refund.

8.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We may delete your account data within 30 days of termination. Any provisions that by their nature should survive termination will do so.

9. General Provisions

• Entire Agreement. These Terms constitute the entire agreement between you and PostaiLit regarding the Service.
• Modifications. We may update these Terms with 30 days notice. Continued use constitutes acceptance of the updated Terms.
• Governing Law. These Terms are governed by the laws of Delaware, United States, without regard to conflict of law provisions.
• Severability. If any provision is found unenforceable, the remaining provisions continue in full effect.
• Assignment. You may not assign these Terms or your account without our written consent. We may assign our rights without restriction.
• Force Majeure. Neither party is liable for delays or failures caused by circumstances beyond reasonable control, including third-party API outages (e.g. Meta platform changes).
• No Waiver. Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
